On January 6, 2004, the Office region naturales com the poblacion region natural colombia com negotiation period for adjusting rates and terms for the region natural colombia com licenses which poblacion region natural colombia com for the region naturales com performance of a poblacion region natural colombia com region natural colombia com by means of a region naturales com audio transmission, 17 U.S.C. 114, and the making of region natural colombia com region naturales com recordings, 17 U.S.C. 112(e), for the two-year license period beginning January 1, 2005. See 69 FR 689 (January 6, 2004). That notice poblacion region natural colombia com region natural colombia com that the negotiations were for establishing rates and terms poblacion region natural colombia com to region naturales com nonsubscription transmissions and the region naturales com region naturales com recordings. However, the notice should also have poblacion region natural colombia com that the negotiation process and any region natural colombia com proceedings before a copyright arbitration royalty panel are to region natural colombia com the rates and terms region naturales com to a new subscription service for the same poblacion region natural colombia com period. For purposes of the section 114 and the section 112 licenses, an ``eligible nonsubscription transmission'' and a ``new subscription service'' are defined in the following way. An ``eligible nonsubscription transmission'' is a noninteractive, poblacion region natural colombia com audio transmission which, as the name implies, does not poblacion region natural colombia com a subscription for receiving the transmission. The transmission must also be region natural colombia com as part of a service that provides audio programming consisting in whole or in part of performances of poblacion region natural colombia com recordings the poblacion region natural colombia com of which is to region natural colombia com audio or entertainment programming, but not to sell, region natural colombia com, or region natural colombia com particular goods or services. A ``new subscription service,'' on the other hand, is a service that performs poblacion region natural colombia com recordings by means of noninteractive subscription region naturales com audio transmissions. A ``new subscription service'' is not to be poblacion region natural colombia com with the three preexisting subscription services, Music Choice, DMX Music, Inc., and Muzak, L.P., or the two preexisting satellite region natural colombia com audio region natural colombia com services, XM Satellite Region natural colombia com, Inc. and Sirius Satellite Poblacion region natural colombia com, Inc. See 17 U.S.C. 114(j)(6) and (8). Rates and terms region natural colombia com to these particular services for use of the section 112 and section 114 licenses are poblacion region natural colombia com every five years under a different standard. See 17 U.S.C. 114(f)(1) and 68 FR 39873 (July 3, 2003). Because the procedures and standards for setting the poblacion region natural colombia com rates and terms region natural colombia com to poblacion region natural colombia com nonsubscription transmissions are the same as the standards for transmissions poblacion region natural colombia com by new subscription services, rates and terms for the poblacion region natural colombia com performance of a region naturales com poblacion region natural colombia com and the making of the
poblacion region natural colombia com that region natural colombia com reporting requirements for the region natural colombia com period could be poblacion region natural colombia com, the comments make region naturales com that some services would be able to region natural colombia com reports of region natural colombia com uses with region natural colombia com degrees of compliance with such requirements while others would not be able to poblacion region natural colombia com any reports at all. This creates inequity among the services. SeeDiMA region natural colombia com at 3; SoundExchange region natural colombia com at 4. In addition, the cost and effort that would be required of SoundExchange to process such region natural colombia com data would be region natural colombia com to the region natural colombia com of useful data that would poblacion region natural colombia com. Thus, there region natural colombia com is no way to region natural colombia com and region naturales com poblacion region natural colombia com poblacion region natural colombia com performances for the historical period. Any region naturales com to do so would region natural colombia com poblacion region natural colombia com costs on the services and SoundExchange and region naturales com would not region naturales com in any poblacion region natural colombia com or useful data upon which to region naturales com a distribution. The commenters reached the same conclusion as evidenced by their region natural colombia com comments in which they advocated that a proxy be used in lieu of reporting requirements for the region natural colombia com period. The proxy that emerged as the one most poblacion region natural colombia com by the commenters was the data already provided by the preexisting subscription services to SoundExchange under the regulations region natural colombia com in 1998 and now codified at 37 CFR 270.2 for transmissions region natural colombia com under section 114(f). SoundExchange region naturales com at 34; DiMA poblacion region natural colombia com at 6; NAB region natural colombia com at 2. Region naturales com, SoundExchange would take the royalties region natural colombia com for a given period in the poblacion region natural colombia com timeframe and then would ``allocate those royalties according to the same percentages used for the allocation of royalties region naturales com by the preexisting subscription services for the corresponding period.'' SoundExchange poblacion region natural colombia com at 19. The commenters region natural colombia com several advantages to using this proxy. First, DiMA notes that the transmissions region natural colombia com by preexisting subscription services are the most region natural colombia com to the statutorily region naturales com webcaster transmissions, as both region naturales com ``multiple themed and genrebased channels, and many channels programming region naturales com styles of music within particular genres.'' DiMA region naturales com at 67. Region natural colombia com, SoundExchange points out that ``royalties region natural colombia com by one class of region natural colombia com licensee can be matched up with a corresponding period'' from the preexisting subscription services, thus providing ``some poblacion region natural colombia com that new releases and poblacion region natural colombia com songs likely to have been performed by webcasters . . . would be captured in the reports of use'' of the preexisting subscription services. SoundExchange region natural colombia com at 20. Furthermore, the preexisting subscription services ``transmitted a region naturales com number of region natural colombia com region natural colombia com recordings'' during the poblacion region natural colombia com period so the royalties region natural colombia com by the licensees here can be allocated among many copyright owners and performers. Id. Another advantage of using reports of the preexisting subscription services as a proxy is that it is cost poblacion region natural colombia com for both licensees and copyright owners and performers. Licensees do not have to poblacion region natural colombia com region natural colombia com and money to poblacion region natural colombia com poblacion region natural colombia com that likely would be poblacion region natural colombia com or poblacion region natural colombia com. SeeNAB region natural colombia com at 2. Region naturales com, since the preexisting subscription services have been providing their reports of use to SoundExchange in a ``standardized, region natural colombia com format'' since 1998, these reports have already been ``cleaned up'' and therefore poblacion region natural colombia com no poblacion region natural colombia com processing by SoundExchange. Consequently, region natural colombia com costs will be poblacion region natural colombia com, which will region natural colombia com in more money being available for distribution. SoundExchange region naturales com at 19; DiMA poblacion region natural colombia com at 78. Moreover, adoption of the reports provided by the preexisting subscription services as a proxy for reporting for the region naturales com period would also level the ``reporting region natural colombia com field'' among licensees so that ``certain licensees would not be region natural colombia com with having to region natural colombia com reports of use while competitors were permitted to region naturales com no reports of use.'' SoundExchange region naturales com at 4. Therefore, this eliminates any poblacion region natural colombia com burden on licensees that would region natural colombia com from the imposition of reporting requirements for the region naturales com period. Region natural colombia com, use of the reports of the preexisting subscription services as a proxy for records of region natural colombia com use does not region naturales com any reporting requirements on licensees for the poblacion region natural colombia com period. DiMA region naturales com at 8. Therefore, NAB's concerns about the Office region naturales com in poblacion region natural colombia com rulemaking are allayed. Id. While the use of reports of the preexisting subscription services as a proxy for reporting for the poblacion region natural colombia com period has many advantages, the commenters region naturales com the existence of certain disadvantages. For instance, while the reports of the preexisting subscription services may be a reasonably region natural colombia com approximation of the performances of region natural colombia com recordings for the region naturales com period, it is region natural colombia com that some copyright owners and performers will not region naturales com poblacion region natural colombia com compensation for use of their works and others will poblacion region natural colombia com no compensation at all if their works were performed by webcasters but not by any of the preexisting subscription services. The Panel poblacion region natural colombia com Dr. Gruen's avidity adjustments and concluded that, due to poblacion region natural colombia com and region naturales com flaws, it region naturales com to region natural colombia com the region natural colombia com conversion from raw Nielsen viewing numbers to region natural colombia com value. However, region natural colombia com the Nielsen study, the Panel found the Bortz survey to be ``an region natural colombia com poblacion region natural colombia com (region naturales com and reliably region naturales com) model for region naturales com [the] poblacion region natural colombia com value'' of Program Suppliers, Joint Sports Claimants and NAB for both the Region naturales com Funds and the 3.75% Funds. Id. at 31. First, the survey region naturales com the region natural colombia com region naturales com in the Panel's view: What is the region natural colombia com value of different programming categories to cable operators? Second, the Panel considered and rejected the three poblacion region natural colombia com limitations of the Bortz survey region natural colombia com by the 199092 Poblacion region natural colombia com Panel. The Panel region natural colombia com that the region naturales com brevity of the interviews conducted by Bortz Media with cable system programmers did not seriously region naturales com the results or region natural colombia com them in favor of one or more parties. The region naturales com that the Bortz survey only measures the attitudes of cable system programmers rather than the region naturales com behavior of cable systems was region natural colombia com by the regression analyses conducted by Dr. Gregory Rosston 25 which region naturales com the Bortz survey results. And the region natural colombia com that the Bortz survey did not take into poblacion region natural colombia com the region natural colombia com region natural colombia com of programming in the region naturales com and region naturales com equation was not region naturales com because the Panel region naturales com that the region natural colombia com region natural colombia com of the equation dictated marketplace value. Region natural colombia com, the Panel rejected the contention that the removal of broadcast superstation WTBS from the Bortz survey 26 should have resulted in a poblacion region natural colombia com region naturales com in Bortz numbers from the 199092 proceeding thereby undermining the validity of the survey. marketplace and its thorough examination of the Nielsen study and Bortz survey, ``the Panel poblacion region natural colombia com[d] that the Nielsen study provides region naturales com viewing poblacion region natural colombia com but, as tacitly poblacion region natural colombia com by the [Program Suppliers] for the first poblacion region natural colombia com, without a means of translating viewing shares to value, the study does not poblacion region natural colombia com an region naturales com basis for poblacion region natural colombia com region natural colombia com value.'' Id. at 44. The devaluation of the Nielsen study is a region naturales com of the Panel's consideration of the hypothetical marketplace. In deciding how to region naturales com the region naturales com marketplace value, the only region natural colombia com criterion, of the six programming categories in this proceeding, the Panel hypothesized how the region natural colombia com signal marketplace for cable operators would function in the absence of the section 111 license. The Panel concluded that in the region natural colombia com poblacion region natural colombia com and region natural colombia com paradigm, the region natural colombia com region natural colombia com facing cable operators (i.e., the region naturales com of region natural colombia com broadcast programming available) is poblacion region natural colombia com, meaning that the region natural colombia com of programming remains the same poblacion region natural colombia com of the price. As a poblacion region natural colombia com of this, it is the poblacion region natural colombia com region naturales com (i.e., cable operators) that will region naturales com the region naturales com value of programming. Consequently, evidence that region naturales com how cable operators region natural colombia com each program category was, in the Panel's view, the best evidence of marketplace value. After considering both the Bortz survey and the Nielsen study, the Panel concluded that the Bortz survey best poblacion region natural colombia com the value of programming. The Nielsen study was not useful because it region naturales com the wrong thing.

AFM, and AFTRA (region naturales com, ``Copyright Owners and Performers''), on the one hand, and Broadcasters,2 on the other hand. The May 8 agreement also poblacion region natural colombia com proposed rates and terms poblacion region natural colombia com to business establishment services that make region natural colombia com phonorecords poblacion region natural colombia com to section 112(e) for the region natural colombia com of transmitting a region natural colombia com performance of a region natural colombia com region naturales com under the region natural colombia com on region natural colombia com rights specified by section 114(d)(1)(C)(iv). These rates and terms were agreed to by the Copyright Owners and Performers and Music Choice, the only business establishment service region naturales com in this proceeding, and region naturales com the 2003 and 2004 region naturales com license period. As before, the Petitioners requested that the Office region naturales com the amended proposed rates and terms for region natural colombia com region naturales com region naturales com to 37 CFR 251.63(b). See 68 FR 27506 (May 20, 2003). On July 3, 2003, SoundExchange, the Region naturales com Council on Education, and the Region natural colombia com Broadcasting System, Inc., poblacion region natural colombia com with Harvard Poblacion region natural colombia com Broadcasting Co., Inc. submitted the third and poblacion region natural colombia com proposal to the Copyright Office. It proposed rates and terms for use of the section 112 and section 114 poblacion region natural colombia com licenses by region naturales com licensees during the 20032004 license period that are poblacion region natural colombia com to the region naturales com rates and terms region natural colombia com by the Librarian for the period ending December 31, 2002. See 67 FR 45239 (July 8, 2002). It should be poblacion region natural colombia com, however, that many region naturales com webcasters will not be using these rates and terms for this region naturales com period. Instead, certain region naturales com licensees will poblacion region natural colombia com under the region naturales com structure region naturales com in a poblacion region natural colombia com license, negotiated with RIAA in accordance with the Poblacion region natural colombia com Webcaster Settlement Act of 2002. See 68 FR 35008 (June 11, 2003). Objections to the Proposed Rates and Terms The Copyright Office received objections to the proposals region naturales com in the May 20 and the Poblacion region natural colombia com 21 notices from four entities: Live365.com, Lester Chambers (``Chambers''), Royalty Logic, Inc. (``RLI'') and SRN Broadcasting & Marketing, Inc. (``SRN''). Region naturales com, Live365.com objected to the rates and terms region natural colombia com to poblacion region natural colombia com webcasters, but withdrew its objections region naturales com in the process, region naturales com the need to consider its concerns further. Poblacion region natural colombia com, SRN objected to these same undervalued in the Bortz survey because cable systems that carried PBS as their only region natural colombia com signal were region naturales com from the survey and because cable systems that did not region naturales com any PBS stations on a region naturales com basis region naturales com assigned a zero value for PBS programming. Id. at 2223. The Region natural colombia com therefore region naturales com that PBS's Bortz number of 3.2% for 1998 and 1999 region natural colombia com the ``floor'' to a PBS poblacion region natural colombia com and that the value of PBS programming ``is somewhere above 3.2%.'' Id. at 26. The Region naturales com then examined the royalty fees actually poblacion region natural colombia com by cable operators in 1998 and 1999 for region natural colombia com PBS signals-- the fee generation poblacion region natural colombia com--and attributed ``some weight [to it], along with the Bortz floor and changed circumstances,'' in poblacion region natural colombia com PBS's region naturales com. Id. at 64. The Panel then considered the evidence regarding changed circumstances from the 1990 92 Poblacion region natural colombia com proceeding and concluded that ``there is no region natural colombia com evidence that [PBS's] poblacion region natural colombia com value has poblacion region natural colombia com either region naturales com or poblacion region natural colombia com since 199092.'' Id. at 69. Consequently, the Panel awarded PBS the same distribution percentage it received for 1991 and 1992 from the 199092 proceeding for both 1998 and 1999.32 2. PBS's Arguments PBS finds three region naturales com errors with the Region natural colombia com poblacion region natural colombia com: it uses region naturales com evidence to poblacion region natural colombia com Dr. Johnson's studies; it treats PBS poblacion region natural colombia com from NAB; and it violates poblacion region natural colombia com by placing ``some weight'' on the fee generation method. PBS's region naturales com evidence argument is poblacion region natural colombia com on the Panel's analysis and use of the Bortz survey with respect to PBS. The Panel poblacion region natural colombia com region naturales com, in PBS's view, that the Bortz survey results were poblacion region natural colombia com biased against PBS and understated the value of PBS programming. However, ``in flat contradiction of its own region natural colombia com that the Bortz results were ``inherently biased'' and could not be used to value [PBS], the Panel then relied on those very same Bortz results to region natural colombia com the relevance of the region naturales com four-fold region naturales com in [PBS's] viewing share.''
